Mobile Network Operator (MNO), Netone has begun the hunt for a new CEO despite pending legal issues with former Boss Lazarus Muchenje over his contract termination.
The state run mobile telecoms firm, led by acting vice chairperson Susan Mutangadura handed Muchenje his dismissal later in July last year,days after being reinstated as CEO.
A termination which he challenged saying is illegal as he can not be fired on notice and without the presidents endorsement like Susan and the Netone board did.
In retaliation, Muchenje then went on to sue Mrs Mutangadura, the whole board of members and Netone. The court application also sought to bar Netone from publishing his illegal dismissal and advertising his post.
However, the court case between Netone and Muchenje was this year deferred to the labour court by high court Judge Esther Muremba saying they have no obligation to deal with labour issues before they are handled by the Labour court.
“The High Court had no jurisdiction, as a court of first instance in labour issues and these should first be dealt with by the Labour Court.” She said
While the labour courts decision on the legal issues of weather Netone can fire Muchenje on a three months notice is still pending, the firm has started hunting for a new boss claiming that the president endorsed his dismissal on 21 December, 2020.
A claim which Muchenje dismissed 2 days later saying he does not believe the president endorsed his contract termination.
“Assuming but without accepting that the president has given his endorsement which for the avoidance of doubt is disputed, the decision to dismiss the applicant is illegal, arbitrary and affront to the laws of natural justice in that the applicant has never been invited to make any misrepresentations.” He said.
An advertisement published by a recruitment consultant this week said the telecoms firm was looking for a dynamic team leader to steer the group.
“Our client, NetOne Cellular (Private) Limited seeks to engage a dynamic self-driven, and results-orientated professional to fill the critical and strategic role of group chief executive officer,” said the consultant.
Now that Netone has made their move , it is still to be seen how Muchenje will respond.
